Supreme Court Upholds Arizona Election Laws; A Great Weeping and Gnashing of Teeth Begins on the Left

The Supreme Court's 6-3 ruling on Thursday swatted down the Democratic National Committee's latest attempt to invalidate voter integrity laws, this time in the state of Arizona.

Citing Section 2 of the Voting Rights Act of 1965, the DNC argued that two of Arizona's existing election laws were, you guessed it, discriminatory toward minority voters. The first is the requirement that voters must cast their ballots at their assigned precinct and the second is the state's ban on ballot harvesting.

Basically, the court said that states have the right to prevent fraud in their elections.

In the majority opinion, Justice Samuel Alito wrote:

Arizona law generally makes it very easy to vote.


Fraud can affect the outcome of a close election, and fraudulent votes dilute the right of citizens to cast ballots that carry appropriate weight. Fraud can also undermine public confidence in the fairness of elections and the perceived legitimacy of the announced outcome. Ensuring that every vote is cast freely, without intimidation or undue influence, is also a valid and important state interest.


Section 2 of the Voting Rights Act provides vital protection against discriminatory voting rules, and no one suggests that discrimination in voting has been extirpated or that the threat has been eliminated. But Section 2 does not deprive the states of their authority to establish non-discriminatory voting rules.

In her dissent, Justice Elena Kagan wrote: “What is tragic is that the court has damaged a statute designed to bring about ‘the end of discrimination in voting.'”

Kagan was joined by Justices Stephen G. Breyer and Sonia Sotomayor.

The Washington Times reports that the DNC filed this lawsuit in 2016.

The DNC argued that minority voters were disenfranchised by these laws. These individuals were forced to "wait in long lines at assigned precincts and may not have transportation to get to their polling locations."

A U.S. District Court ruled against the DNC. In their decision, they wrote that at least "99% of the minority voters cast ballots in the correct precincts."

This ruling was reversed by the full 9th U.S. Circuit Court of Appeals which determined the state "enacted laws with discriminatory intent." Despite the lower court's statement that 99 percent of minority voters had voted in the correct precinct, the court ruled that Section 2 of the Voting Rights Act is violated when “more than a de minimis number of minority voters … are disparately affected.”

The state's Republican Attorney General Mark Brnovich appealed this decision to the Supreme Court.

Following Thursday's ruling, Brnovich declared, “Fair elections are the cornerstone of our republic, and they start with rational laws that protect both the right to vote and the accuracy of the results.”

This decision was bad news for Democrats who wish to take away state's rights to decide how elections will be run and hand control over to the federal government.

Democrats want every future election to afford them the same opportunity to commit fraud as the 2020 election did.

On Thursday night cable TV, liberals reacted with a great weeping and gnashing of teeth. They understand the significance of this ruling for future decisions on voting laws in both federal courts and the Supreme Court.

Last week, Attorney General Merrick Garland and his underling, the far-left Kristin Clarke, announced that the Civil Rights Division of the DOJ, which Clarke heads, will file a lawsuit against the state of Georgia over the state's recently passed Election Integrity Act of 2021. The lawsuit claims that this law is discriminatory toward blacks and its purpose is to suppress the minority vote. I posted about this here.

This foolish and misguided lawsuit is pure political theatre and the Supreme Court's decision on Thursday does not bode well for its success.

CNN's John King said, "Republicans have decided, 'we don't like what happened in 2020.' We expanded voting rights because of Covid, we made it easier to vote by mail, we made it easier to vote early..."

Yes we did John and look what the %#&@ happened!

Additionally, Democrats are well aware that the results of the forensic audit of ballots cast in Maricopa County, Arizona in November 2020 will be released soon. Because there have been no leaks from the audit team, we don't know yet if evidence of fraud was discovered.

If fraud is found, litigation will immediately follow that will ultimately reach the Supreme Court.

There was speculation last week that the DOJ's lawsuit against Georgia may have been an attempt to intimidate the Supreme Court, the message being, 'Stay in line or we'll pack the court.'

Democrats also know that there are active challenges to the election results in other states and potential challenges in still more.

The left has tried hard to make the notion that fraud occurred in the presidential election as toxic as the narrative that COVID-19 escaped from the Wuhan lab once was.

Chances are looking good that both will be proven correct.
